  • Please do not contact the Court unless you have a question not answered on this website. The information presented on this website from the Justice Court, Pct 2, of Wheeler County is being given to aid you in taking care of the alleged violation with which you have been charged, without appearing in court. Do not contact the Court to discuss evidence (your side of the story). The Judge cannot talk with you regarding testimony or evidence (Ex-Parte).
    • Deferred Dispositions

      With a plea of GUILTY OR NOLO CONTENDERE , payment of court costs, fine, and special expense fee, and a written request, on or before the appearance date on your citation, you may qualify for a deferred disposition. A Deferred Disposition is a 30 day probationary period whereby you are required to not receive any moving violations during that probationary period. Also, if you are age 18 through 24, you must also complete an accredited Drivers Safety Course (DSC) in order to comply with the Deferred Order. Your deferral period is increased from 30 days to 60 days. If you comply with all requirements, your violation will be dismissed and not show on your driving record. The written request (the reverse side upper portion of the Court Information Sheet may be used as your request in writing) and payment of the suggested amount of fine (see back of Court Information Sheet) plus a $ 75.00 special expense fee, must reach the Court before the appearance date on your citation. Persons under the age of 18 wanting a deferred disposition, please contact the Court direct for additional information. Holders of any COMMERICIAL DRIVER LICENSE and alleged speeds of 100 mph or more do not qualify for a deferred disposition.

    • Pleading Nolo-Contendere or Guilty

      PLEAS:
      GUILTY-YOU ADMIT FAULT AND ARE PLEADING GUILTY TO THE CHARGE(S) ON YOUR CITATION.
      NOLO-CONTENDERE (NO CONTEST)- YOU DO NOT ADMIT FAULT BUT ARE PAYING THE FINE AMOUNT SHOWN FOR THE CHARGE(S) LISTED ON YOUR CITATION.

    • Pleading Not Guilty

      Send or Bring an appearance Bond, properly executed in the amount equal to twice the amount of the suggested fine. (See Fine Amounts), on or before the appearance date on your citation, and a trial date will be set for the Court to hear your case. You are not required to have an attorney present.

    • Texas Drivers License Holders & Active Military Personnel – Drivers Safety Course

      If you hold a valid Class C TEXAS driver license ,or are active military, or spouse of an active military person, are not currently taking a DRIVERS SAFETY COURSE (DSC) to have a citation dismissed, have not taken the DSC within the past 12 months to have a citation dismissed, have proof of financial responsibility(insurance), and your speed is less than 25 miles per hour over the posted speed limit, you qualify to take the DSC to have this citation dismissed. YOU MUST give the Court written notice you are requesting to take a DSC on or before the appearance date on your citation, provide the Court with a copy of your driver license, copy of proof of your active military status, your proof of financial responsibility, and pay the Court costs plus a dismissal fee for a total of $130.00 on or before the answer date shown on your citation. You may use the reverse side upper portion of the Court information brochure given to you by the officer for your written request. You will have 90 days from the date the Court receives your information and payment to complete a Drivers Safety Course and forward the certificate of completion to us. Also, you are required to provide the Court with a Driving Record during the 90 day deferral period. You can obtain this from the Department of Public Safety, Driver Improvement & Control, P. O. Box 4087, Austin, TX 78773), or go to www.texas.gov. BE SURE you contact the Court within the time allowed on the Citation. There are no extensions to provide the Court with the required Certificate of Completion and driving record. Failure to comply will result in you being summoned to Court to Show Cause why you did not comply with the judge’s order. HOLDERS OF A COMMERCIAL DRIVER’S LICENSE DO NOT QUALIFY.

    • Alternatives to Payment of Fines and Costs

      A defendant who is convicted of a criminal offense punishable by fine only is entitled to alternative methods of satisfying the judgment against them if they are unable to pay the fine or cost, in whole or in part. 

      Those alternative methods include:

      1) A payment plan, allowing the defendant to make payments toward the fine and cost in designated intervals. Note that if any amount is paid more than 30 days after the judgement assessing the fine or costs them a $15.00 time payment fee must be assessed. 

      2) Disposition of the amount assessed by performing community service(TEXAS RESIDENTS ONLY). There are many options that meet the requirements of the law for community service, see ART. 45.049 of the Code of Criminal Procedure for full details. A defendant is entitled to a minimum of $100 credit for every 8 hours of community service performed. 

      3) If performing community service imposes an undue hardship, a defendant who is indigent or who lacks sufficient resources to pay is entitled to a wavier of the fine and cost, in whole or in part.

      If you are wanting to file for indigency with the Court, please contact the phone numbered provided. There are forms that you will have to fill out and send back to the Court to prove that you are indigent. The Judge may request copies of check stubs, bills in your name, etc., when you file for indigency, or at any time after the case has been deemed indigent.
